2. Acceptance of these terms
By creating an account, or by continuing to use In My Care, you agree to these terms. If you do not agree, do not use the service. Where you set up a care circle on behalf of an organisation, you confirm you have authority to bind it.
2a. Eligibility
You must be 18 or over and able to enter a binding agreement to hold an account.
3. Invite-only access
In My Care is not a public network. Access to a care circle is granted by invitation or by an approved access request.
4. Account security
Keep your sign-in details private. Do not share a password or let another person use your account. Tell us promptly if you believe your account has been accessed without permission.
5. Your responsibilities
- Record care information honestly and accurately.
- Correct mistakes through the record process rather than deleting evidence.
- Only enter information you are permitted to enter.
6. Care-circle permissions
Roles determine what a member can see and do. Coordinators, primary carers and family admins can manage the care plan. Family viewers have read-only access to reporting areas.
7. Authority to upload another person's information
By uploading information about the person being cared for, you confirm you have the authority to do so and have recorded the basis for that authority where the app asks for it.
8. Acceptable use
Use of the service is subject to the Acceptable Use Policy and, for chat and Moments, the Community Rules.
9. User-generated content and ownership
You keep ownership of what you upload. You grant us a limited licence to store, process and display that content for the purpose of operating the service for your care circle.
10. Moderation and enforcement
Coordinators may moderate content within their care circle. We may restrict features, suspend or terminate access where these terms or the Acceptable Use Policy are breached.
11. Account termination and deletion
You can leave a care circle or request account deletion in the app. Certain care records, financial records, consent records and audit records may be retained.
12. Intellectual property
The application, its software, design, branding, documentation and content, other than content you upload, belong to Recommunicated and are protected by intellectual property law. You receive a limited, non-exclusive, non-transferable right to use In My Care within the plan you have selected. You must not reverse engineer, resell, redistribute or circumvent the technical limits of the service.
13. Availability and maintenance
We aim to keep the service available but do not guarantee uninterrupted access.
In My Care is provided on an "as available" basis. We do not warrant that the service will be uninterrupted, timely, secure or error-free, and we do not offer a contractual uptime guarantee. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, satisfactory quality and fitness for a particular purpose. Keep your own copy of anything you cannot afford to lose - the app provides a full export.
14. Third-party services
The service relies on third-party hosting, storage and notification providers.
15. Orders, payments and our reseller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- Plans. In My Care has a free plan and a paid Premium membership, billed monthly or yearly. Current prices are shown on the Pricing page before you buy and again at checkout, and include any applicable VAT or sales tax as calculated by Paddle.
- Trial. Premium starts with a 3-day free trial. If you do not cancel before the trial ends, the plan you selected begins and the first payment is taken.
- Renewal. Memberships renew automatically at the end of each billing period at the then-current price until cancelled. We will tell you in advance of any price change affecting your renewal.
- Failed payments. If a payment fails, Paddle retries it over a short period and we will ask you to update your card. Your access continues while this happens. If payment ultimately fails, the membership is cancelled and the account returns to the free plan.
- Cancellation. You can cancel at any time from the Plans screen in the app, which opens Paddle's billing portal. Cancelling stops future billing and your Premium access continues until the end of the period you have already paid for. Your records are never deleted when a membership ends - anything outside the free plan's limits is simply hidden until you subscribe again.
- Changing plan. Switching between monthly and yearly takes effect immediately and Paddle prorates the difference.
- Refunds. See our Refund Policy.
- Buyer terms. Payment, billing, tax, cancellation and refund mechanics are also governed by Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms.
16. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that:
- We are not liable for indirect, consequential or special loss, including loss of profits, loss of goodwill, or loss or corruption of data.
- We are not liable for a decision about someone's care, medication or health made in reliance on the app. In My Care is a record-keeping tool, not a clinical system - see section 17.
- Our total liability arising out of or in connection with the service in any 12-month period is limited to the fees you paid us for the service in the 12 months before the claim arose, or GBP 100 if you use the free plan.
You agree to indemnify us against claims arising from content you upload, from your unlawful use of the service, or from your breach of these terms.
17. Medical and emergency limitations
In My Care records and organises care information. It does not diagnose, prescribe, monitor clinically, or replace a doctor, nurse, pharmacist or emergency service. It is not an emergency-alert or emergency-response system. See the Medical and Emergency Disclaimer.
18. Governing law and disputes
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere you keep the benefit of any mandatory protections of your own country's law. Please contact us first - most issues are resolved quickly. Billing disputes should be raised with Paddle, who handle all order enquiries.
